who we are

Hopkins Action is a UK sole trader business. “We” and “us” means Hopkins Action. You can reach us at info@hopkinsaction.com.

services

quotes

Every job is quoted in writing. A quote is valid for 30 days and says what is included. Anything outside it is extra work, and we will agree the price with you before we do it.

paying

We may ask for a deposit before work starts; the quote says how much. Invoices are due within 14 days unless the quote says otherwise. We can pause work while an invoice is overdue.

your part

You give us the content, access and feedback the job needs, on time. If that is late, the delivery date moves with it. You confirm you have the right to use anything you send us, such as words, photos and logos.

who owns what

Once a job is paid in full, you own the work we made for you: designs, copy, photos and the website itself. We can show it in our portfolio unless you ask us not to.

Our own software, including Club Manager Pro and our booking system, stays ours, and you get a licence to use it on your site. Fonts, plugins, stock images and other third-party items stay under their own licences.

hosting and ongoing work

Hosting, software licences and ongoing work run for the period agreed and renew unless you tell us to stop. Either of us can end them with 30 days’ notice. You keep your website and content when you leave.

if you are a consumer

If you hire us as a private person, you can cancel within 14 days of agreeing a job. If you ask us to start within those 14 days, you pay for the work done up to the point you cancel.

software bought from this site

Our plugins are sold through Freemius, which acts as the reseller and merchant of record. Freemius takes the payment, adds any tax due and sends your licence key, and its own terms cover the purchase. We make and support the software.

• A licence covers the number of sites in your plan, and brings updates and support for as long as it is active.
• Yearly and monthly licences renew automatically until you cancel, which you can do at any time from your Freemius account. Yearly renewals are 30% off.
• Lifetime licences are paid once and do not renew.
• Not happy? Ask for a refund within 30 days of buying and you get your money back.
• Free trials end on their own. You only pay if you choose to buy.
• The plugins are open source under the GNU General Public License (version 2 or later). The licence key covers updates and support.

liability

We do the work with reasonable skill and care. We are not liable for indirect losses, such as lost profit, lost data or lost business. Our total liability for any job or licence is limited to what you paid us for it in the 12 months before the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else the law does not allow us to limit. If you are a consumer, your legal rights are not affected.

the rest

We may update these terms. The version on this page when you agree a job or buy a licence is the one that applies. These terms are governed by the law of England and Wales.
